👉 User Accounts

Any person of legal age residing in an authorized country may create an account on Artur.art, as an artist or buyer.

Data Collected at Registration

  • Last name, first name, email address, country of residence, phone number
  • Artistic preferences (optional)
  • Delivery information
  • Payment information

Data is used strictly and exclusively for order management and is never transferred to third parties.

User Commitment

The user agrees to provide accurate information, to adopt respectful behavior on the platform, and not to use Artur.art for illegal or abusive purposes.

👉 Intellectual Property and Artwork Image Rights

Original and Custom Artworks

Copyright remains the property of the artist. The buyer obtains a private usage right (personal display). Any commercial use requires a separate written license.

Works Generated by the iArt Machine

  • These works are the exclusive property of Artur.art unless they have been commissioned and paid for.
  • Once purchased, the AI artwork becomes the property of the buyer, according to the agreed usage (private or commercial).

Image Use by Artur.art

  • Artur.art may use artwork visuals for promotional purposes (website, blog, podcast, iArt sketch).
  • The artist accepts this clause by default upon registration, but may deactivate it upon written request.

👉 Use of the iArt Machine

Purpose of the AI Tool

The iArt Machine is used solely to generate preview sketches intended to help the client formulate their order and the artist to better understand it. These sketches are not commercialized and are not used to train a public AI.

Ownership and Exclusivity

  • AI sketches belong to Artur.art as long as they are not purchased.
  • In case of purchase, the rights are transferred to the client.
  • The artist's style is not copied or replicated, and no artist's works feed an external model.

Technical Guarantees and AI Documentation

Artur.art guarantees that the AI system used is local, closed, and independent of any external training database. No artwork is used to feed a public AI or to reproduce a style. Technical documentation can be provided to the artist upon request to confirm these guarantees.

Refusal by the Artist

The artist may refuse at any time to receive orders from the iArt Machine.

👉 Responsibilities, Content and Sanctions

Artur.art's Responsibility

As an intermediary, Artur.art can only be held responsible up to the order amount, excluding cases of serious, intentional or fraudulent fault, in accordance with Quebec law.

Force Majeure

In case of strike, war, pandemic or any other event beyond its control, Artur.art suspends its obligations without compensation.

Authorized and Prohibited Content

Strictly prohibited:

  • Hateful, discriminatory, defamatory or illegal content
  • Works violating third party rights

👉 Explicit sexual content is permitted, within an artistic framework respectful of Canadian law.

Sanctions

Any serious breach of these terms of sale may result in suspension or deletion of the user account, or even the instigation of legal proceedings before the competent court.
